Terms of Service

Your account

You must be at least 18 years old and able to enter a binding contract to use the Service. Give us accurate details and keep them up to date. You are responsible for everything that happens under your account, so keep your password secret and tell us at contact@orbivo.net if you think someone else has used it.

What Orbivo does

Orbivo turns product details and pictures you provide into images and videos using third-party AI models. Results are generated automatically. They can contain errors, visual flaws or content that does not match your request, and the same request can give different results. Review every result before you publish it.

We may change, add or remove features and models at any time. We try to keep the Service available, but it can be interrupted for maintenance or by problems outside our control.

Your content

You keep all rights to the product details, pictures, videos and other material you upload (your “Inputs”) and, as between you and us, to the images and videos the Service makes for you (your “Outputs”). You give us a worldwide, non-exclusive, royalty-free license to host, copy, process and send your Inputs and Outputs only as needed to run the Service for you, including sending them to the AI providers that do the generation.

You confirm that you own or may use everything you upload, including product photos, logos and brand names, and that every person whose face or voice appears in your Inputs has agreed to that use. You are responsible for how you use your Outputs, including any claim they make in advertising.

Acceptable use

Do not use the Service to create or share content that is unlawful, deceptive, defamatory, hateful or sexually explicit, or that infringes someone else's rights. Do not impersonate a person or brand you may not represent, show real people without their consent, or make false claims about products.

Do not try to break, overload, copy or reverse engineer the Service, get around its limits or security, or reach it through automated means other than the ones we provide. We may remove content and suspend accounts that break these rules.

Credits, plans and payments

Generation is paid for with credits, which come with a subscription plan or a one-time credit pack. Prices are shown in US dollars before you pay, and taxes are added where the law requires them. Payments are processed by Stripe; we never see or store your full card number. Every generation shows its credit cost before you start it.

Credits do not expire while your account is open. They have no cash value, cannot be transferred or exchanged for money, and belong to the workspace that bought them.

Subscriptions renew automatically at the end of each billing period until you cancel. A cancellation takes effect at the end of the current period. A move to a higher plan is charged at once, prorated for the rest of the period; a move to a lower plan starts at the next period. We may change prices for future periods and will tell you before a change applies to your subscription. Our Refund Policy is part of these Terms.

Ending your use

You can stop using the Service at any time and ask us to close your account by writing to contact@orbivo.net. We may suspend or close an account that breaks these Terms, puts the Service or other people at risk, or that the law requires us to close. When an account closes, its unused credits lapse unless the law says otherwise.

Disclaimers

The Service and every Output are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or free of errors, or that Outputs will be accurate, unique or fit for your purpose.

Limitation of liability

To the fullest extent the law allows, ORBITENSA LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims about the Service is limited to the amount you paid us in the 12 months before the claim arose.

You agree to cover ORBITENSA LLC against claims, losses and costs that arise from your Inputs, your use of Outputs or your breach of these Terms.

Changes to these Terms

We may update these Terms. The date at the top shows the current version. We will tell you about a material change in the Service or by email before it takes effect, and using the Service after that means you accept the new Terms.

Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in Pinellas County, Florida, and both you and we accept their jurisdiction. Nothing in these Terms limits a consumer right that the law of your country does not allow to be waived.

If a translation of these Terms differs from the English text, the English text applies.
